Terms of Service & Usage Policy

1. Service Delivery Policy

• Platform Compliance: FirstSMMProvider provides promotional marketing solutions designed to boost your appearance and reach across supported platforms including Telegram, Instagram, YouTube, and TikTok. Users must ensure their campaigns adhere to the general guidelines of the respective social media networks.
• Delivery Timelines: Estimated start times and delivery speeds listed in service descriptions are approximations based on server capacity. We do not guarantee exact delivery timestamps. Orders in "Processing" or "In Progress" cannot be canceled while being actively fulfilled by our servers.
• Algorithm Updates & Drop Rates: Social media platforms update their internal security and spam filters periodically. While we offer stable and high-retention services, sudden platform-wide updates may affect drop ratios. Guarantee periods apply strictly according to the designated refill terms of the specific service ordered.
• Service Type Substitutions: If a specific server faces temporary maintenance or downtime, FirstSMMProvider reserves the right to deliver through an equivalent or superior server tier to ensure order completion without delay.

2. Order Placement & Account Requirements

• Public Profile Obligation: All target accounts, channels, groups, and posts MUST remain Public throughout the entire delivery and refill window. Placing an order for a private profile will lead to order failure, and such orders do not qualify for manual cancellation or refunds.
• Accurate Target Links: Users are solely responsible for submitting correct URLs (e.g., direct post links for views/likes/reactions, or public channel links for member additions). Orders placed with incorrect or broken links cannot be reversed or refunded once dispatched to our automated nodes.
• Simultaneous Orders: Do not place multiple orders for the same target link across different servers or panels simultaneously. Our system cannot differentiate overlapping counters, and we cannot guarantee or refund inaccurate metric deliveries resulting from concurrent campaigns.
• Large Existing Accounts (100k+ Baseline): If a channel, group, or profile already possesses 100,000+ existing metrics prior to placing an order, standard refill coverage may be restricted. In high-volume accounts, external organic drop-offs cannot be distinguished from server deliveries.

3. Refill & Guarantee Terms

• Refill vs. Non-Refill Tiers: Services labeled "No Refill" or budget-tier offerings (such as bulk non-refill followers) are delivered as-is without retention warranties. Refill-supported services provide automatic or manual button refills within the active guarantee timeframe (e.g., 30 days, 60 days, or 365 days).
• Refill Button Activation: When an eligible drop occurs on a refill-supported service, users can trigger the automated refill request directly from the Order History page in their user dashboard.
• Start Count Benchmark: Refill calculations depend strictly on the recorded "Start Count" and "Remains" data generated at the time of order creation. If the count drops below the initial start count due to pre-existing organic drops, refill eligibility may be voided.

4. Payment, Wallet & Refund Policy

• Wallet Deposit Model: All funds deposited into your FirstSMMProvider account balance are intended exclusively for purchasing platform services. Once a deposit is credited, payments cannot be reversed or refunded back to original payment methods (e.g., Crypto, Payeer, Perfect Money, or Bank Transfer).
• Failed & Partial Deliveries: If a service becomes permanently unavailable or fails delivery, the system automatically marks the order as "Canceled" or "Partial" and credits the remaining unspent funds directly back to your FirstSMMProvider wallet balance.
• Disputes & Chargeback Prohibition: Users agree never to initiate an unauthorized chargeback or payment gateway dispute. Filing a dispute or fraudulent reversal will result in immediate termination of the user account, permanent IP block, and revocation of delivered metrics where technologically viable.
• Fraud Prevention: The use of stolen payment instruments or unauthorized funds will result in immediate permanent account suspension and relevant legal reporting.

5. API Terms for Resellers

• Fair API Usage: Resellers utilizing our direct provider API must configure their automated workflows to respect standard polling limits. Abusive script loops or excessive server requests may result in rate-limiting or temporary API key suspension.
• Client Management: Resellers operate independently. FirstSMMProvider holds no contractual obligation to third-party end clients managed by resellers. End-user support remains the sole responsibility of the respective panel owner.

6. Privacy & Data Security

We value your confidentiality. Any information submitted to FirstSMMProvider (including usernames, account emails, target URLs, and transaction IDs) is processed exclusively for order execution and system verification. We do not sell, rent, or distribute personal information to external third parties. All backend database records are safeguarded using encrypted security protocols.

7. Liabilities & Disclaimer

Disclaimer of Warranties: FirstSMMProvider shall not be held liable for any commercial losses, account restrictions, content removals, or disciplinary measures imposed by third-party social media networks (such as Telegram, Instagram, Meta, or Google). Services are purchased voluntarily as independent promotional enhancements.

Prohibited Content: Users are strictly prohibited from utilizing our panel for illicit promotions, hate speech, copyright violations, adult-restricted material, or activities that contravene standard international digital conduct laws.
